Terms and conditions

Article 1. General

  • These terms and conditions apply to all offers, agreements and services of Outdoor Harderwijk and Veluwe Mountainbike, based in Harderwijk, Gelderland.
  • By using our services or hiring our vehicles, you agree to these terms and conditions.
  • Deviations from these terms and conditions are only binding if confirmed in writing by Outdoor Harderwijk or Veluwe Mountainbike.
  • Photos and videos taken by us may be used for marketing purposes. If you would rather not appear in them, please let one of our staff know.
  • In the case of a day hire, the vehicle must be returned before closing time.

Article 2. Bookings and Cancellations

  • Bookings can be made by phone, by email or via the Outdoor Harderwijk website and are only final once confirmed by Outdoor Harderwijk.
  • Cancellations must be notified to Outdoor Harderwijk in writing or by email. Cancellations made more than 7 days before the booked date are free of charge. For cancellations within 7 days before the booked date, 50% of the total amount will be charged. For cancellations within 48 hours before the start, the full amount will be charged.
  • Outdoor Harderwijk reserves the right to cancel a booking in the event of force majeure, including extreme weather conditions such as thunderstorms. In such a case, Outdoor Harderwijk will propose an alternative date.

Different conditions regarding cancellation and minimum numbers of participants apply to companies, groups and requested quotes.

  • Upon acceptance of a quote, the number of participants specified by the client is the contractual minimum number to be purchased and is decisive for invoicing. Any changes to a lower number of participants after acceptance fall under the cancellation conditions below. Tip: give a conservative number when accepting, so that it can still be increased if necessary without incurring extra costs.
  • Cancellations and reductions in the number of participants are charged as follows: Cancellation or reduction of the number of participants up to 35–42 days before the start of the activity (or activities) is free of charge. Cancellation or reduction of the number of participants between 21–28 days before the start is charged at 50% of the total booking value. Cancellation or reduction of the number of participants between 14–20 days before the start is charged at 75% of the total booking value. Cancellation or reduction of the number of participants within 14 days before the start is charged at 100% of the total booking value.
  • The invoice is sent prior to the activities and must be paid within 14 days of the invoice date, unless otherwise agreed in writing. Any additional costs, such as drinks charged afterwards, will be invoiced separately at a later date.
  • Outdoor Harderwijk reserves the right to cancel the activity (or activities) in the event of force majeure. In that case, an alternative date will be proposed in consultation.
  • Weather conditions are not a valid reason for free cancellation, with the exception of extreme weather conditions such as thunderstorms or snowfall, where the safety of participants is at risk.

Article 3. Use of Vehicles

  • The hirer is obliged to use the vehicles with care and in accordance with their intended purpose.
  • It is not permitted to use the vehicles under the influence of alcohol, drugs or other narcotic substances.
  • The hirer must comply with the applicable traffic rules and the instructions of Outdoor Harderwijk or Veluwe Mountainbike.
  • The E-choppers may only be used by persons holding a valid driving licence.
  • It is not permitted to sublet the vehicles or activities to third parties.
  • It is not permitted to transport mountain bikes or other hired vehicles by car, trailer, bike rack or any other motorised means of transport, unless prior written permission has been given by Outdoor Harderwijk. Transport of vehicles outside the use for which they were hired is entirely at the hirer's own risk. Any damage, loss or theft during such transport is entirely at the hirer's expense.

Article 4. Liability, Damage and Breakdowns

  • In the event of a breakdown, contact the emergency number immediately so that we can get you going again or offer a suitable solution.
  • The hirer is fully liable for damage to, loss or theft of the hired vehicles during the hire period, regardless of the cause.
  • In the event of damage or loss, the full cost of repair or replacement will be charged to the hirer.
  • Outdoor Harderwijk or Veluwe Mountainbike is not liable for any damage (direct or indirect) arising during the use of the vehicles.
  • The hirer indemnifies Outdoor Harderwijk or Veluwe Mountainbike against claims by third parties arising from the use of the vehicles.
  • Outdoor Harderwijk or Veluwe Mountainbike does not reimburse the costs of repairs carried out by third parties.
  • If a key is lost, €15 will be charged per key.
  • Any fines incurred during the hire period are entirely at the hirer's expense.

Article 5. Payment

  • Payment must be made in advance, unless otherwise agreed.
  • In the event of late payment, Outdoor Harderwijk or Veluwe Mountainbike reserves the right to cancel the booking.
  • All prices include VAT, unless stated otherwise.

Article 6. Safety and Responsibility

  • Our premises are under camera surveillance. By taking part in activities or entering Outdoor Harderwijk, you consent to any recordings being made.
  • Wearing a helmet is compulsory during certain activities; please follow the instructions of Outdoor Harderwijk or Veluwe Mountainbike staff.
  • The hirer is responsible for the safety of all participants and must ensure that all participants are familiar with the rules of use.
  • The lead booker is responsible for the entire group.

Article 7. Force Majeure

  • Outdoor Harderwijk or Veluwe Mountainbike is not liable for failure to fulfil obligations as a result of force majeure, including but not limited to extreme weather conditions, natural disasters, pandemics or other unforeseen circumstances.

Article 8. Governing Law

  • All agreements and services of Outdoor Harderwijk are governed by Dutch law.
  • Disputes will be submitted exclusively to the competent court in the Netherlands.

Article 9. Final Provisions

  • Outdoor Harderwijk or Veluwe Mountainbike reserves the right to amend these terms and conditions. Changes will be communicated in good time via our website.
  • If any provision of these terms and conditions proves to be void or voidable, the remaining provisions will remain in full force.
